January 2013 Criminal Assizes: January Tuesday 15th

court3.jpgA total of six sexual assault cases were brought before Justice Bernie Stephenson Brooks, as the January 2013 Criminal Assizes started on Tuesday January 15th 2013.

The cases heard at the High Court included charges such as; unlawful sexual intercourse, indecent assault, abduction, unlawful sexual connection, and incest.

The office of the Director of Public Prosecutions (DPP) is represented by DPP Gene Pestaina along with State attorneys Clement Joseph and Arthlyn Nesty.

Steven Wyke and Johan Charles inmates at the State Prison, previously pled guilty to burglary will have to wait for Monday January 21st for sentencing.

Justice Brooks ordered a welfare report be conducted on the men, which she will use to decide their sentence.

Gershon Baron who was charged with the men however his trial has been adjourned for March 1st 2013.

Shermel Christopher was charged with causing grievous bodily harm with intent.

His trial was set for January 30th 2013.

Edward Ravalliere who was charged with causing grievous bodily harm, will have to wait for January 24th for his trial to begin, while Syd Khan Nigel Henry’s trial for his causing grievous bodily harm with intent, case been set for January 21st 2013.

Another wounding with intent case which involves Andy Alexander Cassel is set to begin on February 18th 2013.

Okim Lestrade was charged with inflicting grievous bodily harm on Sammantha Wright, who was said to have been his girlfriend at the time.

His case will commence on February 27th 2013. The alleged incident occurred on March 13th 2010.


In more court news;

During the sitting of the January 2013 Criminal Assizes, the Director of Public Prosecutions Office discontinued 4 matters.

This decision resulted in Joycelyn Benjamin, Samuel J. Abel and Sylvester Matthew regaining their freedom, which they were all thankful for.

A notice of discontinuance for a case of threats was also made in regards to convicted murderer Sherman Webb.

Webb, was found guilty of the murder of Barbadian Corey Poleon, and was on Friday July 20, 2012 sentenced to life in prison by Justice Bernie Stephenson Brooks.

The trial of murder accused Shane Degallarie after being traversed to the January Criminal Assizes, will begin on March 1st 2013.

Degallerie has been charged for allegedly murdering Justin Joseph of Fond Cole on April 23, 2010.

The trial initially commenced on September 26, 2012 but came to an abrupt end on October 8, 2012 when the court was informed that the foreman who is also a juror was hospitalized due to illness.

Justice Bernie Stephenson, previously told the court and jury that, because of the nature of the offence, all nine members are required to be present during the hearing, and that since one juror was still incapacitated, the jury was discharged.

Degallerie who is represented by Zena Moore Dyer, Gina Dyer Munro and Joshua Francis remains on bail of $30,000, with the surety being Gail Romain.

Clement Labassiere’s murder case trial will begin on Monday January 21st.

The case of Edward “Alcapone” Green of Morne Daniel who has been charged with  murdering 35 year old Damien Dorival, whose headless body was found on Elmshall Road in June 2008, has been traversed to the May 2013 Criminal Assizes.

Director of Public Prosecutions Gene Pestaina removed himself from the matter, while Attorney for Green Peter Alleyne requested more time to prepare, as the case was just passed onto him this morning.


Continuing with the Criminal Assizes;

Eshanette Joseph to the amazement of the Court pled guilty to the charge of theft, where she allegedly stole the sum of EC $11,218.18, the property of Mrs. Linda Hill.

The case has been adjourned for March 1st for sentencing, as Justice Brooks ordered a pre-sentencing report to be carried out on the defendant.

An arrest warrant has been issued for Marcus Matthew who was charged with handling stolen goods and theft.

He was bailed on his own recognizance in the sum of $25000.

However, Director of Public Prosecutions Gene Pestaina informed the Court that he has information that suggests Matthew has left Dominica via the back door method.
